These Terms of Service ("Terms") govern your access to and use of Prospektr™ (the "Service"), operated by Busy Screenprinting ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.
Note: This document is template legal language we have published in good faith for transparency. We strongly recommend consulting an attorney before relying on it for high-stakes commercial relationships.
1. Agreement
These Terms form a binding agreement between you (or the entity you represent) and us. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
Prospektr is a B2B prospect-discovery platform that uses public business directories and large language models to help decorator businesses identify and qualify potential customers. The Service includes dashboards, search results, classification reasoning, optional third-party integrations, and email digests.
3. Account & access
You are responsible for maintaining the security of the email address used to sign in. We send sign-in links via email; anyone with access to that inbox can sign in to your workspace. You agree to notify us immediately of any unauthorized use.
4. Subscription & billing
The Service is offered on monthly or annual subscriptions. The first month is offered at a promotional rate of $1; on day 31, your card is charged the full plan price you selected at sign-up and renews monthly (or annually) thereafter.
You may cancel at any time through your account's billing portal. Cancellation takes effect at the end of your current billing period; we do not pro-rate refunds for partial months. See our Refund Policy for details.
We may change subscription pricing with at least 30 days' notice. Price changes do not apply to your current billing period.
5. Acceptable use
You agree to use the Service only for lawful B2B prospecting purposes and in compliance with all applicable laws (including CAN-SPAM, GDPR, CCPA, and similar regulations governing your outreach). See our full Acceptable Use Policy for prohibited activities.
6. Customer data
You retain ownership of all data you input into the Service (your Customer Data). We process Customer Data solely to provide the Service and as described in our Privacy Policy. Prospect records discovered by the Service for your workspace are made available to you and are not resold to other customers.
7. Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by us and protected by intellectual-property laws. You receive a non-exclusive, non-transferable license to use the Service for the duration of your subscription.
8. Disclaimers
The Service is provided "as is" without warranty of any kind. Classification reasoning generated by AI may contain inaccuracies; you are responsible for verifying any prospect data before contacting them. We do not guarantee any specific number of qualifying leads, conversion rate, or revenue outcome.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim. We shall not be liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account if you breach these Terms or our Acceptable Use Policy. Upon termination, your access ends and your data is retained for 30 days before permanent deletion (see Privacy Policy).
11. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts of Orange County, Florida.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
